1. Master Architectural Agreement
By accessing pinex.co.uk, interacting with the Secure Client Portal, or downloading our software payloads, you are entering into a legally binding architectural agreement with PineX Limited. You agree to utilize our codebase strictly within the bounds of standard legal frameworks and hold PineX Limited harmless against any infrastructural damages caused by improper deployment, misuse, or violation of these terms.
2. Account Security & Passwordless OTP Integrity
You are solely responsible for maintaining the strict security of the email address associated with your PineX account. Because our architecture relies on passwordless, email-based One-Time Passwords (OTP), access to your email constitutes absolute administrative access to your software licenses and billing data. PineX is not liable for stolen cryptographic keys or modified billing settings resulting from compromised client email accounts.
3. Service Level Agreement (SLA) & Engineering Support Definitions
Active license holders are granted access to Level 2 and Level 3 engineering support via the Secure Client Portal. Support is strictly defined as technical assistance directly related to the deployment, configuration, and bug resolution of PineX software. We absolutely do not provide generalized WordPress consulting, custom feature development upon request, server management, or third-party plugin debugging under standard SLA terms.
4. Acceptable Use Policy & Infrastructure Protection
You are expressly prohibited from utilizing PineX software to facilitate illegal operations, distribute malware, or execute malicious payloads. Furthermore, you may not deploy automated scraping scripts against pinex.co.uk or attempt to reverse-engineer our licensing API matrix. Any detected hostile actions will trigger an immediate, permanent IP and account ban.
5. Intellectual Property & Brand Asset Ownership
The "PineX" name, brand identity, logos, custom iconography, documentation, and the overall front-end architecture of pinex.co.uk are the exclusive intellectual property of PineX Limited. You are strictly forbidden from utilizing these assets to falsely represent your own products, create counterfeit distribution hubs, or mislead consumers regarding your affiliation with PineX Limited.
6. Subscription Billing, Upgrades, and Terminations
Software licenses are sold on an annual recurring billing matrix to ensure continuous access to security patches and SLA support. You authorize PineX Limited (via our payment processors) to automatically charge your payment method on file at the end of each billing cycle. You may autonomously terminate your subscription at any time via the Portal; doing so leaves your license active until the end of the current term, after which it will expire.
7. Limitation of Liability & Indemnification
To the maximum extent permitted by applicable law, PineX Limited, its engineers, directors, and affiliates shall not be held liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of profits, data corruption, server downtime, or revenue disruption arising from the use or inability to use our software matrix. Our total liability in any matter arising from this agreement is strictly limited to the total amount paid by you for the software during the 12 months preceding the claim.
8. Governing Law & Jurisdiction
This master agreement and any dispute or claim arising out of it shall be governed by and construed in accordance with the strict laws of England & Wales. Both parties irrevocably agree that the courts of England & Wales shall have exclusive jurisdiction to settle any dispute or infrastructural conflict arising from this architectural agreement.
